Dinakaran's fate hangs on a faint 'No, No'

NEW DELHI: Justice P D Dinakaran, Chief Justice of Karnataka, does not figure in the list of four names that have been forwarded to the Union Law Ministry for elevation to the apex court. However, his name has not been dropped, according to the Chief Justice of India.

 

The four who have been cleared by the collegium are Justice A K Patnaik (Chief Justice of Madhya Pradesh HC), Justice Tirath Singh Thakur (Chief Justice of Punjab and Haryana HC), S S Nijjar (Chief Justice of Calcutta HC) and K S Radhakrishna (Chief Justice of Gujarat High Court).

 

It has been learnt that Justice Dinakaran's name was de-linked pending an independent investigation to find out the veracity of the allegations levelled against him. In other words, his name has been dropped for the time being, but not permanently.

 

When mediapersons asked CJI K G Balakrishnan about the issue on Sunday, on the sidelines of a conference at Vigyan Bhawan, he said a decision in this regard was yet to be taken. He said the Collegium had not decided on dropping the name of Justice Dinakaran. However, his name had been "de-linked" from the rest of the four judges recommended for elevation to the apex court.

 

"We have asked the names of four judges to be processed for appointment," the CJI said.

 

To the question whether Dinakaran's name had been dropped, the CJI initially said, "No, no", but, later said, "We have not taken any decision as yet".

 

It is learnt that the Collegium, at its meeting last week did consider the issue but deferred its decision.
